1. INTERPRETATION
Bins: Portable waste bins provided by London Bin Rentals Inc. (LBR) under this Agreement. Environmental Laws: All applicable federal, provincial, and municipal laws, regulations, and bylaws governing waste management, health, and environmental safety. Hazardous Substances: Any material classified under Environmental Laws as hazardous, toxic, or requiring special handling or disposal. Permitted Bin Contents: Only materials specifically approved by LBR as acceptable for disposal under this Agreement.
2. PAYMENTS
Customer agrees to pay all rental and disposal charges within 10 days of invoice. All bin rentals are subject to a minimum pre-authorization or immediate charge to the Customer’s payment card at the time of booking. Final billing is based on the actual dump weight as determined by the disposal site. The Customer’s card will be charged immediately or within 48 hours after the actual weight and corresponding disposal fees are confirmed. Prices are subject to change based on actual dumping fees, fuel costs, and third-party disposal rates. Late payments may incur interest as outlined in Section 12.
3. BIN CARE AND PROPERTY PROTECTION
The Customer shall not modify or move the bin. The Customer is responsible for keeping the bin safe, clean, and in proper condition. Bins must be used only for Permitted Bin Contents. Customers are encouraged to place protective boards on their driveways before bin delivery. While LBR takes every precaution, we are not responsible for any surface, driveway, or property
damage resulting from the bin, truck, or equipment placement/removal.
4. NO LIQUIDS OR WET MATERIALS
The Customer must not dispose of liquids, paints, oils, wet concrete, or any liquid-producing materials in the bin. If such materials are found, the Customer shall be liable for all costs associated with cleanup, removal, transportation, and proper disposal as required by law.
5. NO HAZARDOUS OR PROHIBITED MATERIALS
The Customer must not place any Hazardous Substances or prohibited materials in the bin. This includes but is not limited to tires, paint, chemicals, fuel, oils, batteries, propane tanks, aerosols, or asbestos. If hazardous items are found, the Customer will be responsible for all resulting costs, penalties, and disposal fees.
6. CUSTOMER RESPONSIBILITY
The Customer assumes full responsibility for the bin and its contents while on their property. Bins must not be overfilled; materials must not extend beyond the bin’s rim or interfere with safe transport. The Customer is responsible for ensuring only approved waste is placed in the bin.
7. INDEMNITY AND LIABILITY
The Customer agrees to indemnify and hold harmless London Bin Rentals Inc., its officers, employees, and agents from any claims, damages, or expenses arising from improper use or loading of bins, damage to property or surroundings, or breach of these terms by the Customer. LBR is not liable for any damage to surfaces, landscaping, underground utilities, or other property
resulting from bin placement or pickup.
8. ACCESS AND SITE CONDITIONS
The Customer must ensure that LBR trucks have clear and safe access to the bin at all times. The placement area must be firm and capable of supporting heavy vehicles and equipment. LBR is not responsible for damages to driveways, lawns, underground structures (septic, water, or sewer lines) caused by insufficient site conditions. If access is blocked or delayed, additional charges may apply.
8A. GRASS WAIVER
London Bin Rentals Inc. takes care to place bins responsibly; however, the Customer acknowledges that the placement or movement of bins and trucks on lawns or grassed areas may result in indentations, ruts, or surface damage, particularly in wet or soft ground conditions. By accepting delivery, the Customer waives any and all claims against London Bin Rentals Inc. for damage to grass, soil, or landscaping arising from the placement, movement, or removal of bins or related equipment. If the Customer requests that a bin be placed on a grassed area, it is done entirely at the Customer’s own risk.
9. REFUSAL OR CANCELLATION
LBR reserves the right to refuse pickup or cancel service if bins contain hazardous or liquid materials or are unsafe to transport. LBR may cancel any order at its discretion and refund unused rental charges where applicable.
10. WARRANTIES
London Bin Rentals Inc. provides no express or implied warranties regarding the suitability or fitness of bins or services for any specific purpose.
11. BREACH AND REPOSSESSION
If the Customer breaches this Agreement, LBR may terminate the contract and recover the bin without notice. The Customer remains liable for all outstanding payments, damages, and disposal costs incurred due to such breach.
12. INTEREST
Outstanding balances beyond the due date will accrue interest at 2% per month (24% per annum) until paid in full.
13. AMENDMENTS
No modifications to this Agreement shall be valid unless made in writing and signed by both the Customer and LBR.
14. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario. If any provision is deemed invalid, the remainder shall continue in full effect.
15. ASSIGNMENT
The Customer may not assign this Agreement without written consent from London Bin Rentals Inc.
16. DELAYS
LBR is not liable for any delay in service caused by weather, traffic, landfill closures, or other circumstances beyond its contro
